Avis Rent A Car sues customer over damages to stolen vehicle

NEW ORLEANS – A car company is suing an individual alleging he was responsible for damages its vehicle suffered after it was stolen.

Avis Rent A Car System, LLC filed suit against Larry Bankston on April 15 in the Orleans Parish District Court.

The plaintiff claims that on April 17, 2014 Bankston rented a 2014 Buick Regal, which was to be returned on April 23, 2014. On April 20, 2014 the defendant parked the plaintiff’s vehicle on the 1100 block of North Miro Street in New Orleans, in front of his home and noticed the car was missing three days later. On that date the defendant allegedly reported the plaintiff’s vehicle missing to the New Orleans Police Department. The plaintiff contends that the defendant further reported that he did not attempt to locate the plaintiff’s vehicle.

On April 23, the plaintiff alleges the car was located at 3233 Canal St. in New Orleans and when it was recovered it had sustained damage to its left front side and other areas. The plaintiff claims the defendant caused severe property damage to its vehicle and, according to the rental agreement, the defendant is responsible for all property damage. Avis Rent A Car claims it has suffered a loss of $22,758.89.

An unspecified amount in damages is sought for failing to secure the vehicle, failing to safeguard the vehicle, failing to properly care for the vehicle and any and all other acts of negligence and fault which will be shown through discovery or at trail of this matter.

Plaintiff is represented by Brian K. Abels and Scott H. Nettles.

The case has been assigned to Division F Judge Christopher J. Bruno.
