A tugboat worker is suing the boat's owner, alleging injuries on the job.
Tommy Franklin filed a lawsuit June 17 in U.S. District Court for the Eastern District of Louisiana against Kevin Gros Consulting and Marine Services Inc., alleging negligence.
According to the complaint, on Dec. 23, 2013, Franklin was working for the defendant as a Jones Act seaman on the M/V Alex Gross II, a tugboat. The suit says Franklin was involved in an accident that day resulting in injuries to his right shoulder and other body parts.
The suit alleges the defendant is guilty of breach of its duty to provide for Franklin's safety and failing to provide a safe workplace, train Franklin properly, take precautions for safety, maintain and seaworthy vessel, and provide minimum safety standards, equipment and personnel.
The plaintiff alleges injuries, pain and suffering, lost wages and earning capacity, disability and medical expenses.
Franklin seeks unspecified damages, plus costs. He is represented by attorneys Timothy J. Young, Tammy D. Harris, Megan C. Misko and Daniel J. Poolson Jr. of The Young Firm in New Orleans.
