NEW ORLEANS – A New Orleans woman claims her son was seriously injured after being hit by a train.
Tabrina Huntington, on behalf of her minor child, filed suit against the State of Louisiana through the Louisiana Department of Culture, Recreation and Tourism, New Orleans City Park Improvement Association, Michael T. Picone and their insurer on April 20 in the Orleans Parish Civil District Court.
The plaintiff claims that on April 20, 2014, an accident occurred in Orleans Parish when a train owned by the defendants and operated by Michael T. Picone suddenly and without warning struck the plaintiff’s son who sustained injuries and damages. The plaintiff contends that the accident resulted solely from the negligence of the defendant Picone.
The defendant Picone is accused of failing to keep a proper lookout, failing to see what he should have seen, operating his vehicle in a reckless manner and such other acts of negligence.
An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental anguish, distress, and suffering, loss of enjoyment of life, and other damages as may be proven at trial.
The plaintiff is represented by Pete Lewis and Barrett R. Stephens, Lewis & Caplan.
The case has been assigned to Division F Judge Christopher J. Bruno.
