Picture framing company sued after mirror allegedly shatters during delivery

NEW ORLEANS – A woman who claims she was injured when receiving delivery of a mirror she had ordered is suing over alleged injuries from glass shards when the mirror shattered. 

Christian Pellerano filed suit against Travelers Indemnity Company, Arts Conscious Picture Framing LLC, and ABC Company on April 21st in the Orleans Parish District Court.

The plaintiff claims that on April 23, 2014 she was an invitee at the Arts Conscious Picture Framing LLC in New Orleans.

As the plaintiff was handling the packacge, suddenly and without waning broken glass shards came out of it and severely cut the plaintiff’s ankle and foot. The plaintiff contends that as a result of the incident, she sustained serious personal injuries resulting in surgery and permanent nerve damage and scarring.

The defendants are accused of gross and wanton negligence and the sole cause of the plaintiff’s accident and resulting injuries.

The defendant is accused of allowing the glass mirror to be delivered, transported, or moved by an untrained and reckless employee, failing to supervise and instruct their employees in the proper delivery, transportation or movement of the glass mirror, generally failing to exercise due care under the circumstances, and such other acts and omissions as will be shown at the trial of this matter.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering and loss of function,mental anguish and emotional distress, lost wages and diminished earning capacity, special care and services, loss of enjoyment of life, and permanent partial disability.

The plaintiff is represented by James A. Hatch.

The case has been assigned to Division N Judge Ethel S Julien.
