A welder who was working on a ship in dry dock is suing the owner of another ship that allegedly collided with the dock while he was working, causing the welder to be injured.

Louisiana resident Damien Jackson filed suit against Ohio River Salvage Inc. in U.S. District Court for the Eastern District of Louisiana on Aug. 6, citing negligence.

According to the claim, Jackson was working as a welder for Kody Marine Inc. at the company’s shipyard on the Harvey Canal in Jefferson Parish when the collision occurred on May 28. The captain of the marine vessel Shannon Holston, owned by Ohio River Salvage, improperly steered the vessel and a ship it was pushing, causing them both to hit the dock, the lawsuit states.

Jackson, who was working about 10 feet above the dock, lost his balance as a result of the collision, grabbing a hand rail to stop himself from falling overboard. In the process, he hurt his back and sustained other injuries, according to the claim.

Jackson is seeking an unspecified amount for medical expenses, pain and suffering, lost income, diminished earning potential, and other damages.

Jackson is represented by attorney Stephen Armbruster of Scheuermann & Jones LLC in New Orleans.
