A Terrebonne Parish woman is suing Fidelity Investments over claims she has been unlawfully deprived of retirement proceeds.
Dorothy Murray filed a complaint Aug. 28 in the Eastern District of Louisiana against Fidelity Investments Inc., alleging unlawful withholding of funds in violation of the Employee Retirement Security Act of 1974.
According to the complaint, Dorothy Murray and her former spouse, Otis Murray, have been involved in community property proceedings in the 32nd Judicial District Court, Parish of Terrebonne, for several years, during which time Dorothy Murray has tried to gain access and accounting information for Otis Murray's accounts at Fidelity.
The plaintiff alleges that funds that she's been entitled to have been withheld in violation of a Employee Retirement Security Act statute.
The complaint alleges that as a result, Murray has suffered monetary damages, loss of benefits, mental and emotional distress, and compensatory and punitive damages.
Murray seeks to recover damages, benefits, attorney fees, and court costs. She is represented by Anthony T. Marshall of Gonzales.
