Driver sues USAA General Indemnity Co. over claims he is owed underinsured coverage

A driver in the Parish of St. Tammany is suing his auto insurer over claims that he is entitled to receive uninsured/underinsured motorist and medical payments after an accident near Ochsner Boulevard.

Rushton Barrosse filed the lawsuit Aug. 4 in the U.S. District Court of the Eastern District of Louisiana against the USAA General Indemnity Co., his insurance company, seeking compensation for injuries to his neck and back, inflicting disability, medical expenses – past and future – as well as scarring and disfigurement.

According to the complaint, on or about Aug. 5, 2014, Barrosse claims that he was driving on Highway 22 near Ochsner Boulevard when a vehicle owned by John Michel and driven by Bridget Michel rear-ended him, causing him injuries and damages. The complaint states that the Michel's insurance policy with State Farm Mutual Automobile Insurance Co. did not have collision coverage, but did pay $15,000 to Barrosse. This amount was insufficient to cover Barrosse's injuries and damages, according to the complaint.

Barrosse is suing USAA General Indemnity Co. claiming they are liable under the uninsured/underinsured motorist coverage provisions and medical payment coverage in his policy from them because Bridget Michel was an underinsured motorist.

Barrosse is being represented by New Orleans-based attorneys Christopher H. Sherwood and Warren A. Forstall Jr.
