St. Tammany Parish corporation files suit against New Orleans resident for breach of contract

NEW ORLEANS – A New Orleans woman is being sued for allegedly failing to show up to the closing of a property sale she was to undertake with a St. Tammany corporation.

Austin Ventures Properties, LLC filed suit against Judy Spindell Moser in Orleans Parish Civil District Court.

On May 31, Austin Ventures claims to have entered into a contract with Moser to buy her residential property on Cleveland Avenue in New Orleans for $50,000.

The sale was allegedly set to take place on June 30, 2014, however, after numerous attempts to notify Moser of the closing, the defendant failed to appear.

The plaintiff alleges Moser refused to sell the property as a result of certain liens that were placed on the property of which she was unaware. The plaintiff argues that Moser was motivated to cancel the sale as a result of the liens reducing her net proceeds.

Austin Ventures contends that it has suffered losses as a result of the defendant’s breach and seeks specific performance or termination of the agreement plus stipulated damages.

Austin Ventures is represented by Shandy Arguelles of De St. Germain Law Office, LLC in Slidell.

The case has been assigned to Division J Judge Paula A. Brown.
