NEW ORLEANS – A non-profit organization is being sued by its former executive director who alleges she was not paid back wages she is owed.
Joia Crear Perry filed suit against The Birthing Project USA in the Orleans Parish District Court on July 9.
Perry claims that the Birthing Project USA owes her past due wages.The plaintiff alleges that she was in an agreement dated Dec. 30, 2014 with the defendant to serve as their executive director from Jan. 1, 2015 through April 30, 2015 with a salary of $15,000. The plaintiff alleges that, for reasons unrelated to any failure of hers to fulfill the obligations spelled out in her contract, her employment was terminated on Feb. 22.
Perry contends that she is entitled to the full salary she would have received had the full term of her services been reached because her employer terminated her services without good and just cause. The plaintiff claims that the Birthing Project USA’s stated reason for terminating her employment was to “move forward with our plan to hire a permanent executive director and re-locate its national office to a permanent location.”
The defendant is accused of breach of contract.
An unspecified amount in damages is sought for wages owed and attorney’s fees.
