Customer sues Home Depot, alleging injury from falling credit card machine

A St. John the Baptist Parish woman is suing Home Depot, alleging negligence for injuries resulting from a falling credit card machine.

Catherine Fetterolf filed a lawsuit Sept. 16 in 40th Judicial District Court St. John the Baptist Parish, later petitioned for removal by the defendants Oct. 20 to U.S. District Court Eastern District of Louisiana on the grounds of improper jurisdiction. The plaintiff filed against Home Depot U.S.A. Inc., doing business as The Home Depot, store manager Gerald Thiele, and XYX Co, alleging injuries caused by a loosely secured credit card machine.

According to the complaint, on Oct. 2, 2014, Fetterolf was shopping at the Home Depot branch in LaPlace  when a poorly secured credit card machine fell and caused damage to her right index finger and left knee.

The plaintiff alleges negligence on behalf of Home Depot for failing to ensure the safety of the machine, Thiele as manager with responsibility to inspect the machine, and XYZ Co. for poorly installing the machine.

Fetterolf seeks unspecified damages, all costs of suit and other relief deemed appropriate by the court. She is represented by attorneys Richard J. Fernandez and Amber E. Cisney of the Law Office of Richard J. Fernandez in Metaire.
