NEW ORLEANS – An East Baton Rouge Parish-based boat company is being sued for allegedly selling a defective vessel and making shoddy repairs to the craft.
Austin Landry filed a lawsuit against Epic Boats LLC, Cajun Outboards, Inc., E Z Loader Custom Boat Trailers, Inc. and Baton Rouge Telco Federal Credit Union on July 23 in the U.S. District Court for the Eastern District of Louisiana citing a violation of Louisiana Redhibition Laws and the Magnuson-Moss Warranty Act.
On Aug. 1, 2014, Landry bought a boat from Cajun Outboards for $49,007.25, excluding finance charges, the complaint states. Landry claims that upon delivery that boat had defective materials and workmanship, with the defects being discovered within the warranty periods.
Since the purchase, Landry claims he has returned the boat for repairs on numerous occasions. Still, the Epic Boats and Cajun Outboards, according to the lawsuit, have failed to make repairs on the more significant and dangerous conditions.
Landry seeks rescission of the sale, attorney's fees and court costs. He is represented by St. Tammany Parish-based attorney Richard C. Dalton.
