A Nashville barge company is suing a Metairie business, alleging the plaintiff has yet to be paid for services rendered.

Ingram Barge Company filed a lawsuit Nov. 12 in U.S. District Court of the Eastern District of Louisiana against USFGIS.

According to the complaint, on Jan. 8, USFGIS contracted with Ingram Barge to ship iron powder on the Cumberland River to Michoud, La. The payment terms are "cash before discharge" with a penalty rate of $300 per day if no payment is made, the suit says.

The lawsuit alleges the defendant has refused to pay so the cargo was never offloaded and currently remains in Ingram Barge's possession in New Orleans, with penalty charges against the defendant accruing at $300 per day.

The defendant owes the plaintiff $84,500.32 and, despite numerous demands for payment, no payment has been made as of Nov. 6, the suit says.

Ingram Barge Company seeks to recover the full freight and penalty charges due, plus attorney fees, costs, expenses and interest. It is represented by attorney Michael A. Harowski of Fowler Rodriguez in New Orleans.

U.S. District Court of the Eastern District of Louisiana case number 2:15-cv-05830-KDE-SS.
