Couple sues drug company claiming negligence in advertising alleged warnings and risks of Xarelto

NEW ORLEANS – A couple is suing a major drug corporation over its alleged failure to make the risks of a drug known, claiming that the negligence resulted in grave health concerns.

Robert James Farrell and Linda Ackerson Farrell filed a complaint on July 24 in the U.S. District Court for the Eastern District of Louisiana against Janssen Research and Development LLC, et al. alleging negligence, strict products liability, breach of express and implied warranty, fraudulent misrepresentation and other counts.

According to the complaint, Farrell was prescribed the drug Xarelto, which was prescribed as a way to inhibit and reduce the risks of a stroke. Despite the danger of the drug and its poor history, the drug continued to be prescribed to patients, without adequate warnings about the risks. In the years before 2012, there were more than 1,000 incidents related to taking the drug, with at least 60 deaths, the complaint states. After Farrell was prescribed and began taking the drug, he suffered from loss of blood, as well as other side effects which have negatively impacted his life.

Farrell is seeking compensation for all injuries suffered and all legal fees. He is represented by Joseph D. Lane, J. Farrest Taylor and Angela J. Mason of The Cochran Firm in Dothan. The case has been assigned to Judge Eldon Fallon.
