Homebuyer seeks rescission of contract with Autumnwood Homes

NEW ORLEANS – A Louisiana man says Autumnwood Homes sold him a $335,000 renovated house that allegedly had failed a city inspection.

Orlando Vega filed a lawsuit Jan. 28 in U.S. District Court for the Eastern District of Louisiana against Autumnwood Homes Inc., alleging breach of contract.

According to the complaint, Vega bought the home on June 3 for $335,000, plus $3,177 in closing costs. Unbeknownst to him, the home had failed an inspection by the city of New Orleans in February 2015 and that no occupancy permit was ever issued for the property, the complaint states.

Vega seeks a jury trial, cancellation of the contract, a refund of the home’s purchase price and closing costs, plus $20,000 in damages and other fees. He is represented by attorney Kevin C. Schoenberger of the Law Office of Kevin C. Schoenberger in New Orleans.
