Finanicial business accuses Louisiana customer of fraudulent transfer

NEW ORLEANS — A financial business is suing a Louisiana man, alleging fraudulent transfer in the loss of a car.

Ally Financial, Inc. filed a lawsuit March 7 in U.S. Bankruptcy Court for the Eastern District of Louisiana against Schuyler Deller Sanders of Napoleonville, alleging the defendant failed to satisfactorily explain the loss of a 2014 automobile.

According to the complaint, Ally Financial's security interest in a 2014 Chevrolet Malibu has been damaged or reduced in value and it suffered financial losses for the unpaid balance of $30,163.53. 

The suit says Sanders made a false oath to defraud an officer of the state charged with custody of the property, failed to list the vehicle as an asset to his bankruptcy petition and alleged the vehicle was repossessed by Ally. The lawsuit says Sanders transferred the vehicle to Sperro LLC, and sold the vehicle to a third party.

Ally Financial seeks trial by jury and seeks judgment against the defendant of $30,163.53, plus interest, legal fees, costs and any further relief the court deems equitable.
