U.S. accuses Louisiana couple of Social Security fraud

NEW ORLEANS — A government agency is suing a Louisiana couple, alleging false representation in collecting Social Security.

The United States of America, on behalf of the Social Security Administration filed a complaint March 11, in the U.S. Bankruptcy Court for the Eastern District of Louisiana against Daryl Edward Karpinski Sr., and Ellery Ann Karpinski, alleging Daryl Karpinski failed to promptly report that his physical condition has improved and that he was working and earning wages over the substantial gainful activity level.

According to the complaint, the U.S sustained losses and damages due misrepresentations by the Karpinskis. The plaintiff alleges  Daryl Karpinski received disability payments while he claimed to be disabled and was working above the substantial gainful activity level.

The U.S. government seeks trial by jury and judgment denying the defendants' claim for discharge of overpayment of $19,564.18 and other damages as may be deemed equitable and appropriate. It is represented by attorneys Glenn K. Schreiber of U.S. Bankruptcy Court Eastern District of Louisiana in New Orleans, and Michael McGaughran and Henry Ernest Velte III of the Office of the General Counsel Social Security Administration in Dallas.
