Contractor accuses bank of owing more than $778,000

NEW ORLEANS — A Baton Rouge contractor is suing California First National Bank, alleging breach of contract and negligent misrepresentation.

Bho Bros. Construction Co. LLC filed a lawsuit March 31, in U.S. District Court for the Eastern District of Louisiana against California First National Bank of Irvine, alleging the financial institution failed to comply with their agreement.

According to the complaint, Bho Bros. has not received payment for pay applications No. 3 and No. 4, retainage and taxes in the amount of $778,636.14. The plaintiff alleges California First National obligated itself to pay all of its pay applications on the Noranda Alumna construction contract and agreed to fund all invoices on the project under the contract. It has not done so, the suit says.

Bho Bros Construction seeks trial by jury, judgment of $778,636.14, attorney fees, costs and any further relief the court deems proper. It is represented by attorneys Michael R. C. Riess and Chiristy R, Bergeron of Kingmill Riess LLC in New Orleans.
