Woman alleges doctors failed to properly perform procedure

Medical malpractice 05

GRETNA – A woman claims that a medical center failed to complete a bilateral tubal ligation, thus allowing her to become pregnant when she did not desire it.

Tori Young filed a suit against Ochsner Clinic Foundation, Ochsner Clinic LLC, Dr. Veronica Gillispie and Dr. Sharhonda Biley in the 24th Judicial District Court on May 26.

According to the claim, the plaintiff was admitted to Oschner Medical Center on Sept. 19, 2012, for the birth of her fifth child. The suit states that the plaintiff requested that she be sterilized so that she could not have more children. The suit further states that the plaintiff found out that she was pregnant with her sixth child on May 8, 2014, which should not have happened if her Fallopian tubes had been litigated as she had requested.

The defendants are accused of failure to implement appropriate policies to avoid harm to the plaintiff and failing to perform the procedure with the clinical practice guidelines expected.

The plaintiff is seeking an unspecified amount in damages. She is represented by Shirin E. Harrell of Harrell and Nowak LLC in New Orleans. The case has been assigned to Division C Judge June Berry Darrensburg.
