Side By Side Redevelopment Inc. alleges property was damaged by construction project

Contract 02

NEW ORLEANS – A development company is seeking damages after its property was allegedly violated by another organization's construction efforts.

Side By Side Redevelopment Inc. filed a suit against 3F Properties of Louisiana LLC, Carl Fanaro, TBD construction company and TBD insurance company in the Orleans Parish Civil District Court on June 14.

According to the claim, the defendants purchased a property that was located next to the plaintiff's 1939 General St. property in 2015. The suit states that the construction company hired by the defendants stored without authorization materials and equipment on the plaintiff's property and tore down a fence and gate without permission. The suit states the parties communicated and the defendants agreed to pay a fee to the plaintiff for use of the plaintiff's property, but did not pay it or repair the alleged damage.

The defendants are accused of breach of lot usage agreement with the plaintiff, disregarding the owner's requests to remove equipment from their property and failure to pay for the use of the lot.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Julius C. Ford and Patrick Sanders of the Law Office of J. Christopher Ford in Metairie.

The case has been assigned to Division G Judge Robin M. Giarrusso.
