Couple files suit against neighbor alleging tree caused damage to property

GRETNA – A couple claims that a neighbor failed to remedy the damage that her tree was causing their property.

Nanette and Daniel Moreno filed a suit against Deborah Pitre in the 24th Judicial District Court on June 27.

According to the claim, the plaintiffs and defendant own properties that are adjacent to each other on Cleary Avenue. The suit states that the plaintiffs' concrete around their pool and a pipe had been damaged by the roots from defendant's cypress tree. The plaintiffs allegedly contacted the defendant and asked that the tree be removed, even offering to help pay for the cost of the removal, however, the defendant failed to come to an agreement and the tree has purportedly continued to cause damages to the plaintiffs' property.

The defendant is accused of violation of the Louisiana Civil Code through her failure to try to come to a reasonable agreement with the plaintiffs.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Larry E. Demmons of the Demmons Law Firm LLC in Metairie. The case has been assigned to Division G Judge E. Adrian Adams.
