Consumer accuses IT services provider of contract breach

BATON ROUGE — A Louisiana man is suing an IT service provider and consumer reporting agency, alleging unlawful collection practices.

Michael Mulkey of West Feliciana Parish filed a lawsuit July 6 in U.S. District Court for the Middle District of Louisiana against Xerox Education Services LLC, doing business as ACS Education Solutions and Experian Information Solutions Inc., alleging violation of the Fair Credit Reporting Act.

According to the complaint, Mulkey has suffered actual damages, including damaged reputation, emotional distress, mental anguish, stress, humiliation and aggravation due to the actions of the defendants. 

The plaintiff alleges the defendants failed to follow reasonable procedures to ensure maximum possible accuracy in consumer reporting and refused to re-investigate Mulkey's dispute regarding a student loan.

Mulkey seeks a trial by jury, actual damages, punitive damages, attorney fees, litigation expenses and legal costs and such other relief as is appropriate. He is represented by attorney Garth J. Ridge of Baton Rouge.
