Man alleges lung cancer was caused by asbestos exposure at work

NEW ORLEANS – A Lockport couple claims that the husband's lung cancer was a result of his work environment.

Donald Falgout and Nettie Falgout filed a suit against 3M Co. et al. in the Orleans Parish Civil District Court on July 19.

According to the claim, the plaintiff was employed by J. Ra McDermott & Co. Inc. from 1963 to 1982. The suit states that during the time of his employment, the plaintiff was exposed to asbestos and products containing asbestos manufactured by the defendants, but was given neither warning of the danger or protection from it. The suit additionally states that in November 2015, the plaintiff was diagnosed with lung cancer.

The defendants are accused of negligence for exposing employees to such danger, failing to provide warning or protection from the situation, failing to provide a safe work environment and overall negligence with respects to the details of this case.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Alex S. Dunn Jr. of Gori, Julian & Associates PC of New Orleans.

The case has been assigned to Division E Judge Clare Jupiter.
