Couple alleges renovation work done on house left damages that have not been repaired

NEW ORLEANS – A couple is seeking damages, claiming that the work they paid for on their house was not completed satisfactorily.

Roger D. Smith and Georgie E. Smith filed a suit against Master Builders & Contractors LLC, Gurtler Bros. Consultants Inc. and Bayou Brothers Blasting LLC in the Orleans Parish Civil District Court on July 18.

According to the claim, the plaintiffs entered into an agreement with the defendant for the renovation of their property at 1324 Nashville St. in 2015. The suit states that the plaintiffs made payments on time for the work to be completed, but that following the completion of the job they began to notice problems with the building, such as water issues and damages to the siding. Though the defendant allegedly promised to fix the issues, the suit states that they have not done so yet.

The defendants are accused of fraudulent billing, breach of warranty, breach of contract and negligent misrepresentation.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Scott M. Galante and Salvador J. Bivalacqua of Galante and Bivalacqua of New Orleans.

The case has been assigned to Division C Judge Sidney H. Cates IV, Chief Judge.
