Welder accuses maritime businesses of negligence

LAFAYETTE — An Iberia Parish man is suing a maritime business, alleging its negligence caused injuries to the plaintiff. 

Anthony Babineaux filed a lawsuit July 29 in U.S. District Court for the Western District of Louisiana Lafayette Division against Diamond B. Industries LLC, Diamond Boats Inc. and Diamond B. Marine Services Inc., alleging failure to protect, failure to warn, negligence and an unsafe work environment.

According to the complaint, on Aug. 8, 2013, Babineaux was working as a welder on a vessel owned by Diamond when he fell through the floor of a barge and down to the engine. The suit says Babineaux suffered severe and disabling injuries that caused mental anguish, lost earnings, loss of earning capacity, disfigurement, physical impairment and medical expenses. 

The plaintiff alleges the defendants failed to take reasonable precautions for his safety, failed to provide a safe place to work and failed to warn Babineaux of known existing hazards.

Babineaux seeks a trial by jury, all damages, pre-judgment and post-judgment interest, attorney fees and costs and all relief to which he is entitled. He is represented by attorney La'Derical D. Wagner of Law Office of New Iberia.
