Couple alleges travel trailer they purchased has defects, seek sale's rescission

ALEXANDRIA – Two Ascension Parish residents are seeking the rescission of a travel trailer they allege is defective.

Bryant J. Troxler and Holly L. Troxler filed a complaint in the U.S. District Court for the Western District of Louisiana against Heartland Recreational Vehicles LLC; Dixie Motors LLC, doing business as Dixie RV Superstores; and NWAN Inc., doing business as RV Warranty Forever alleging that they violated the Magnuson-Moss Warranty Act and the Louisiana Rehabilitation Law.

According to the complaint, the plaintiffs allege that on March 19, they purchased a 2014 Cyclone Fifth-Wheel travel trailer. Within the first days after purchase, they allege experienced defective conditions with the travel trailer, causing them to suffer damages including but not limited to diminution in value of the vehicle, financial charges, insurance premiums and repair costs. The plaintiffs holds Heartland Recreational Vehicles LLC, Dixie Motors LLC, Dixie RV Superstores and NWAN Inc. responsible because the defendants allegedly failed to disclose the defects, failed to repair the vehicle in a workmanlike manner and failed and refused to buy it back.

The plaintiffs request a trial by jury and seek judgment in their favor, actual damages, consequential damages, out-of-pocket expenditures, pre- and post-judgment interest, attorney's fees and costs. They are represented by Fred A. Pharis of Pharis Law Offices in Alexandria.
