Construction worker alleges Baton Rouge company failed to pay overtime

BATON ROUGE — An East Baton Rouge Parish man is suing a Baton Rouge construction company, alleging failure to pay legally mandated overtime wages.

Grosvin Fernando Herrera filed a lawsuit Aug. 9 in U.S. District Court for the Eastern District of Louisiana against Coastal Industries LLC,  alleging violation of the Fair Labor Standards Act.

According to the complaint, Herrera regularly worked more than 40 hours per week but was not paid overtime for all the extra hours. The plaintiff alleges the defendant failed to pay overtime wages at the rate of one and one-half times his regular rate for all hours worked more than 40 hours per week as required by FLSA.

Herrera seeks a trial by jury, unpaid wages, liquidated damages, interest, attorney fees and legal costs. He is represented by attorneys Daniel B. Davis and Randall E. Estes of Estes Davis Law LLC in Baton Rouge.
