BATON ROUGE – A construction worker has filed suit against his East Baton Rouge Parish employer over claims he is owed unpaid overtime pay.
Angel Hernandez filed a complaint in Aug. 9 in the U.S. District Court for the Middle District of Louisiana against Workers Corporate Construction LLC and Carlos Ramos Garcia alleging that the employer violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he customarily worked more than 40 hours per week but was not paid overtime for those extra hours. The plaintiff holds Workers Corporate Construction LLC and Carlos Ramos Garcia responsible because the defendants allegedly failed to pay overtime wages at the rate of one-and-one-half times his regular rate of pay.
The plaintiff requests a trial by jury and seeks judgment rendered in favor of the plaintiff for accumulated unpaid wages, an equal sum as liquidated damages, reasonable attorneys' fees, interest and costs of this proceeding.
