Language barrier allegedly prevents cleaner from receiving benefits after an on-the-job injury

NEW ORLEANS – A Creole-speaking woman is seeking damages, claiming that her previous employer took advantage of her and her inability to understand English fully after she allegedly sustained an injury while on the job.

Marie Mytil filed a suit against Marriott Hotel Services Inc., doing business as Courtyard Marriott, in the Orleans Parish Civil District Court.

According to the claim, the plaintiff was employed by the defendant at the time of the incident. The suit states that the plaintiff was injured while she was cleaning a room, causing her to tear her ACL. The suit further states that the plaintiff filed a report of the incident, but due to a language barrier, was unable to fill it out properly. The defendant allegedly used the incorrect information that the plaintiff filed to deny her the benefits that she purportedly was owed.

The defendant is accused of acts for omission, negligence, carelessness, recklessness and overall fault in the handling of the situation.

The plaintiff is seeking an unspecified amount in damages. She is represented by Pius A. Obioha, Kelly S Love and LaMarre T. Elder.

The case has been assigned to Division I Judge Piper D. Griffin.
