Kulaga Construction Company among defendants accused of owing money

LAKE CHARLES — An electrical supplier claims it is owed more than $85,000.

Stuart C. Irby Company is suing Kulaga Construction Company Inc., Kulaga company president David Cardy and Boise Packaging and Newsprint LLC, d/b/a Packaging Corporation of America, debtor and guarantor, citing alleged breach of contract and personal guaranty.

Stuart C. Irby Company filed a complaint on Sept. 1, in the U.S. District Court for the Western District of Louisiana against the defendants, alleging that they failed to comply with a commercial credit application.

According to the complaint, the plaintiff alleges that it supplied materials for the defendants' construction project. To date, it has suffered monetary losses for not collecting the outstanding principal amount of $75,695.06 and for service charges in the amount of $9,923.18, the suit alleges. The plaintiff holds the defendants responsible for an alleged failure to fully pay for materials purchased from the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages, pre-judgment and post-judgment interest, costs and expenses of these proceedings and for any other legal or equitable relief.
