Man claims that termite-compromised branch caused him to fall from tree

NEW ORLEANS – A man is seeking damages, claiming that he fell from a tree branch that had been damaged by termites while trimming the tree.

Clarence Singleton filed a suit against Meloney Cosse, also known as Melonie Cosse; Elliot Cosse; Elliot Cosse Jr.; Diamond Investment Properties LLC; John Doe and ABC insurance company in the Orleans Parish Civil District Court.

According to the claim, the plaintiff was helping in the trimming of the defendants' tree on March 14, 2015. The suit states that the plaintiff was caused to fall and injure himself when he stepped on a branch that had been hollowed out by termites and the branch broke.

The defendants are accused of negligence through failing to maintain the tree and failing to take reasonable measure to ensure the plaintiff's safety.

The plaintiff is seeking an unspecified amount in damages. He is represented by Francis M. Olivier of Metairie.

The case has been assigned to Division E Judge Clare Jupiter.
