Jefferson Parish resident accuses shopping plaza operators of discrimination toward disabled people

NEW ORLEANS — A disabled person is suing Tequila Rose LLC and Timothy C. Haygood, shopping plaza operators, citing alleged failure to uphold Americans with Disabilities Act regulations.

Fausto Alvarez filed a complaint in the U.S. District Court for the Eastern District of Louisiana against the defendants alleging that they discriminated against him by failing to make reasonable accommodations.

According to the complaint, the plaintiff alleges that during his visits to defendants' property, he experienced serious difficulty accessing the goods and utilizing the services offered therein due to the architectural barriers. The plaintiff holds Tequila Rose LLC and Timothy C. Haygood responsible because the defendants allegedly failed to ensure that no individual with a disability is excluded, denied services, segregated and/or otherwise treated differently at their property.

The plaintiff requests a trial by jury and seeks an order directing defendants to alter the facility to make it accessible to and useable by individuals with disabilities, asking defendants to evaluate and neutralize their policies toward persons with disabilities, award for attorneys’ fees, costs and such other and further relief.
