Man claims GM sold him a defective vehicle, then allegedly failed to make repairs

NEW ORLEANS — A man is suing General Motors LLC, a car manufacturer, citing alleged breach of written and implied warranties.

Eugene Thobodeaux, Jr. filed a complaint in the U.S. District Court for the Eastern District of Louisiana against General Motors LLC alleging that the car manufacturer violated the Magnuson Moss Warranty Act.

According to the complaint, the plaintiff alleges that, in Feb. 11, 2013, he purchased a new 2013 Buick Encore for personal use. When delivered, the Encore was defective in materials and workmanship, with such defects being discovered within the warranty periods. The defects substantially impaired its use, value and safety. The plaintiff holds General Motors LLC responsible because the defendant allegedly failed to perform the repair work in a good and workmanlike manner within a reasonable time.

The plaintiff requests a trial by jury and seeks rescission of the sales contract, compensation for all damages and out-of-pocket expenses, diminution in value, economic losses, prejudgment and post-judgment interest and all other relief deemed appropriate.
