McDonogh 16 LLC, R4 MCNO Acquisition claim insurer wrongfully denied coverage

NEW ORLEANS – The owner of a New Orleans property alleges an insurer failed to indemnify it in a legal matter.

McDonogh 16 LLC, R4 MCNO Acquisition LLC and R4 Capital LLC filed a suit against Fidelity National Title Insurance Co. and St. Charles Title Corp. in the Orleans Parish Civil District Court on Sept. 29.

According to the claim, McDonogh 16 LLC owns a property on Henriette Delille Street that it intends to use to construct a multifamily senior housing and care facility, while R4 is an investor and majority owner. The suit states a lien was filed and McDonogh 16 paid a settlement of $487,500. The plaintiffs allege that the defendants failed to indemnity the insureds for the lien and that Fidelity later acknowledged the coverage denial was incorrect.

The defendants are accused of breach of contract, breach of good faith and negligence.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Isaac H. Ryan, Keith J. Bergeron and Brian S. Schaps of Deutsch Kerrigan in New Orleans.

The case has been assigned to Division J Judge Paula A. Brown.
