Subrogee files suit against warehousing companies after alleged theft of zinc bundles

NEW ORLEANS – An insurance company is seeking damages for a claim it had to pay for allegedly stolen zinc bundles that were housed in a New Orleans warehouse.

Royal & Sun Alliance Insurance PLC filed a complaint on Nov. 11 in the U.S. District Court for the Eastern District of Louisiana against Access World (USA) LLC, doing business as Pacorini Metals USA LLC, and Seaonus Stevedoring – New Orleans LLC alleging negligence and other counts.

According to the complaint, the plaintiff alleges that in 2016, it suffered damages in the amount of $1,137,000 for subrogating all of Standard Chartered Bank's rights and remedies in respect to the purportedly stolen zinc bundles that were housed at the defendants' facilities.

The plaintiff holds Access World (USA) LLC and Seaonus Stevedoring – New Orleans LLC responsible because the defendants allegedly failed to take reasonable safety measures to prevent the theft of the SCB's zinc bundles and failed to take reasonable and necessary precautions in hiring, and managing their employees, which the suit states caused the theft of the said bundles.

The plaintiff requests a trial by jury and seeks judgment in its favor in an amount sufficient to adequately compensate it for damages, plus interest, costs of the suit and for all additional and equitable relief to which it may be entitled. It is represented by Salvador J. Pusateri, Aaron B. Greenbaum, Gavin H. Guillot and Ryan T. Martin of Pusateri, Barrios, Guillot & Greenbaum in New Orleans.
