GRETNA – A man claims that he was wrongfully told to vacate the property that he owned.
Richard Demarco filed a suit against Eric J. Derbes, The Derbes Law Firm LLC, Edward L. O'Dwyer II, Michael P. O'Dwyer & George L. O'Dwyer in the 24th Judicial District Court on Nov. 30.
According to the claim, the plaintiff has been the owner of a property located at 1 Montecello Ave. since 1986. The suit states that on Oct. 20, 2013, the plaintiff was told to vacate his property by the defendants, who alleged their clients owned the property. He alleges he has incurred damages from court fees and legal fees because of the defendants' actions.
The defendants are accused of malicious prosecution.
The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Stephen M. Wiles and Eli J. Hare of New Orleans.
The case has been assigned to Division C Judge June Berry Darensberg.
