Surviving spouse accuses former employer, successor of ERISA violations

MONROE — An Ouachita Parish woman is suing a former employer and successor, alleging violations of the Employee Retirement Income Security Act. 

Pam Miletello filed a lawsuit Nov. 22 in U.S. District Court for the Western District of Louisiana Monroe Division against RMR Mechanical Inc., Sandra Bellgard Miletello and the succession of Gerald Miletello, alleging failure to comply with the Retirement Equity Act.

According to the complaint, on Oct. 26, 2015, Miletello's former husband, Gerald Miletello was killed in an aircraft crash. As a beneficiary, the suit says, she was entitled to proceeds of her former husband's interest from his insurance plan. 

The plaintiff alleges RMR Mechanical has failed and refused to provide requested information and refuses to acknowledge or process the plaintiff’s claim.

Pam Miletello seeks trial by jury, a statutory penalty of $110 per day, attorney fees, the proceeds of Gerald Miletello’s interest in the insurance plan and all other just relief. She is represented by attorney James A. Rountree of Rountree Law Offices in Monroe.
