Electrical technician alleges injuries on Spar Devils Tower because of nail

NEW ORLEANS – An electrical technician claims an exposed nail head caused injuries to his knee.

Kenneth Gardner filed a complaint on Dec. 12 in the U.S. District Court for the Eastern District of Louisiana against Brand Energy Solutions LLC, ENI US Operating Co. Inc., Deep Gulf Energy II LLC, et al. alleging negligence.

According to the complaint, the plaintiff alleges that in Dec. 30, 2015, he was working in the course and scope of his employment for Omega Natchiq aboard ENI's Spar Devils Tower when his right knee struck an exposed nail head, which caused him to sustain injuries resulting in pain and suffering, loss of income, mental anguish and other damages. The plaintiff holds Brand Energy Solutions LLC, ENI US Operating Co. Inc., Deep Gulf Energy II LLC, et al. responsible because the defendants allegedly failed to ensure the scaffolding did not have any exposed nails and failed to provide adequate lighting for the work he was required to perform.

The plaintiff requests a trial by jury and damages, plus interest, all costs of these proceedings and for all other general and equitable relief. He is represented by Stephen J. Johnson in Houma.
