Louisiana company alleges it was never paid for work

NEW ORLEANS – A shoring company is suing the state of Louisiana, alleging breach of contract in failing to pay $50,000.

Wilbur J. Bill Babin Jr., Chapter 7 trustee for the bankruptcy estate of The Shoring Company of Louisiana LLC filed a lawsuit Jan. 13 against Rosella Joseph and the state of Louisiana, the Office of Community Development, the Disaster Recovery Unit and the Hazard Mitigation Program in Orleans Parish Civil District Court, alleging breach of contract.

According to the complaint, Joseph, entered into an agreement with The Shoring Company Dec. 13, 2010. The suit states the agreement was for the elevation of Joseph's home and that despite receiving grants to be used toward the elevation, Joseph never directed those funds to the plaintiff.

The suit states because Joseph has failed to release the grant funds, the Hazard Mitigation Program did not release the funds to the plaintiff for the work completed. The suit states HMGP, still owes the plaintiff $50,000.

Babin seeks the $50,000, all reasonable damages, court costs, attorney fees and all appropriate relief. He is is represented by attorney Kaja S. Elmer of The Derbes Law Firm LLC in Metairie.

The case has been assigned to Division B Judge Melvin Zeno.
