Fashion company alleges insurance provider failed to cover damages

NEW ORLEANS – A fashion company is suing an insurance company, alleging an unpaid policy following a fire.

S and S-924 Corporation, doing business as American Fashions, filed a lawsuit Jan. 25 against Westchester Surplus Lines Insurance Company in Orleans Parish Civil District Court, alleging breach of contract.

According to the complaint, the plaintiff's property at 1018 Canal St., New Orleans, was damaged due to a fire Jan. 27, 2016. The suit states Westchester Surplus was required to provide coverage for the losses suffered but has failed to do so, resulting in $159,000 in damages for the plaintiff.

The defendant is accused of breach of contract through failing to perform the duties it was required to and failing to protect its customer through financial reparation for damages suffered.

American Fashions seeks all reasonable damages, court costs, attorney fees and all appropriate relief. It is represented by attorney Daya Naef of New Orleans.

The case has been assigned to Division I Judge Piper D. Griffin.
