Son blames insurance provider for mother's death

GRETNA – A son is suing an insurance provider, alleging it was responsible for his mother's death.

Bennie Daigre filed a suit Jan. 31 against Humana Health Plan Inc, as issuer of Medicare Advantage Plan and Humana Health Plan of Louisiana Inc as insurers to Sara Daigre in 24th Judicial District Court, alleging wrongful action leading to death.

According to the claim, the plaintiff's mother, Sara Daigre, was being treated at East Jefferson General Hospital for a hip injury when a small mass was discovered on her leg. The suit states her physicians contacted Daigre's insurance provider, which refused to give the hospital consent to get a biopsy.

The suit states Sara Daigre was again admitted to the hospital Nov. 23, 2015, when she had trouble breathing and doctors found that the size of her tumor had grown. Daigre passed away Jan. 31, 2016, due to the defendants for refusing to allow her to have a biopsy.

The defendants are accused of liability for failing to give consent for the biopsy of Sara Daigre's mass, failing to provide the hospital with the chance of saving her and other negligent acts.

Bennie Daigre seeks all reasonable damages, attorney fees and court costs. He is represented by attorneys Patrick G. Kehoe Jr. and William J. Guste of Guste, Barnett, Schlesigner, Henderson & Alpaugh LLP in New Orleans.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
