GRETNA – A couple is suing Sears, alleging a faulty elevator caused emotional distress.
Shelia Celestine, wife of/and Oliver Celestine filed a suit Feb. 6 against Sears Roebuck and Co. and ABC Elevator Repair and Maintenance Company in the 24th Judicial District Court, alleging negligence.
According to the claim, on Feb. 22, 2016, the plaintiffs were at the Sears Roebuck store at the Oakwood Shopping Center in Gretna. The suit states the Celestines were in the elevator on the first floor, attempting to ascend when the elevator dropped. Upon trying to ascend again, the elevator dropped a second time in a violent manner. The lawsuit says Shelia Celestine suffered severe emotional distress due to the incident.
The defendant is accused of negligently creating an unreasonably dangerous situation, failing to remedy the issue and failing to do what was necessary to protect customers.
The Celestines seek all reasonable damages, attorney fees and court costs. They are represented by attorney Suzette P. Bagneris of The Bagneris Law Firm LLC in New Orleans.
The case has been assigned to Division A Judge Raymond S. Steib Jr.
