Couple alleges negligent property inspection cost them more than $16,000

GRETNA – A Metairie couple is suing a property inspector, alleging a botched inspection cost them more than $16,000.

Charles N. Penner and Barbara N. Penner filed a lawsuit Feb. 14 against Hy-Tech Plumbing Video Inspections and ABC Insurance Company in the 24th Judicial District Court, alleging negligence and breach of contract.

According to the claim, the plaintiffs entered into an agreement for buying or selling property at 4800 Wilson Drive, Metairie. The suit states the petitioners had the property inspected by Hy-Tech who alleged everything was operating as it should be, in terms of piping.

Following the inspection, the lawsuit states, the Penners purchased the property March 16, 2016, but began to experience a series of issues with the property, contrary to what the inspector had reported. The plaintiffs said they found after another inspection by another company, that Hy-Tech had failed to report the problems that were present prior to the purchase of the home.

The Penenrs say they were required to pay $16,340 for a plumbing company to fix the problems.

The defendants are accused of negligence and breach of contract through failing to find the obvious problems and through failing to fulfill the terms of the agreement as well as detrimental reliance.

The Penners seek all reasonable damages and sums due, attorney fees and court costs. They are represented by attorney Edward A. Rodrigue Jr. of Boggs, Loehn & Rodrigue in Metairie.

The case has been assigned to Division D Judge Scott U. Schlegel.

The 24th Judicial District Court Case number 769063.
