Concertgoer sues over injuries

NEW ORLEANS – A Terrebonne Parish woman claims that she was injured when a man fell on her during a concert by the band Tool.

Margeaux Fairley filed a lawsuit Jan. 12 against Jared Mertens Poche, Live Nation Worldwide Inc. and SMG in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, the plaintiff was a guest at the Smoothee King Center in New Orleans on Jan. 31, 2016, when the incident occurred. The suit states that the defendant, Poche, either jumped or fell from the suite above the plaintiff, causing Fairley to receive serious injuries. The plaintiff suspects the defendant was either under the influence of drugs or alcohol at the time of the incident, the complaint said.

The defendant is accused of negligence through reckless actions, failing to see the plaintiff below or modify the actions that were taken and using substances in a way that caused others to be put at risk.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. She is represented by attorney Ryan Reece in Metairie.

The case has been assigned to Division N Judge Ethel Julien.
