Insurance company alleges negligence in kitchen fire

NEW ORLEANS – An insurance company is seeking damages for a fire, allegedly caused by negligence.

Certain Underwriters at Lloyd's London, subscribing to policy number 574657, as subrogee of 1140 Decatur St., Condo Assoc. and subscribing to policy number LBW560175, as subrogee of/and 1130 Decatur LLC, filed a lawsuit March 9 against Fiorella's on Decatur Inc., State Fire LLC and Safety Offshore Service Inc. in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, Fiorella's had contracted State Fire to inspect and service the suppression hood system on its property at 1136 Decatur St., New Orleans. The suit states on March 30, 2016, one of Fiorella's employees turned on a deep fryer in the kitchen when a fire started.

Although the employee tried to squelch the fire, the suit states, the extinguisher did not function property and the tag and needle showed the can to be empty. The plaintiff sys it has paid out $45,355.31 and $21,651.67, but are seeking that the defendant pay the deductible owed.

The defendants are accused of negligently failing to properly inspect and replace the extinguisher, failing to properly train employees on how to do their job or how to respond in such a situation and failing to have a suppression system that functioned.

Lloyd's London seeks $70,506.98, all reasonable damages, court costs, attorney fees and all appropriate relief. It is represented by attorneys R. Todd Musgrave and Theresa S. Anderson of Musgrave, McLachlan & Penn LLC in New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
