Driver sues after highway collision involving garbage truck

GRETNA – A man is seeking damages after his car was allegedly hit by a garbage truck while stopped in traffic along U.S. 90. 

Glenn Forcha filed a suit March 9 against Terrill Smith, Progressive Waste Solutions of LA. Inc., and Arch Insurance Co. in the 24th Judicial District Court, alleging negligence.

According to the claim, the plaintiff, a resident of Jefferson Parish, was driving his vehicle on U.S. 90 in Jefferson Parish on July 5, 2016, when the incident occurred. The suit states that Smith, who was operating a garbage truck, rear-ended the plaintiff's car, causing damage and injuries.

The defendant is accused of negligence through failing to keep a lookout for other cars, failing to exercise reasonable care and negligence in failing to operate the vehicle in a responsible manner.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Patrick Kehoe Jr. in New Orleans.

The case has been assigned to Division M Judge Henry Sullivan Jr.
