Re/Max Commercial Broker claims it never received commission from J.C. Bern-Mas Investments

NEW ORLEANS – A Jefferson Parish real estate broker is seeking damages, claiming that it was not paid a commission.

Commercial Broker Inc., doing business as Re/Max Commercial Broker Inc., filed a lawsuit March 21 against J.C. Bern-Mas Investments LLC in Orleans Parish Civil District Court alleging sums due.

According to the complaint, the defendant made a listing agreement for a real estate property. The suit states that the agreement expired Jan. 13, 2011, and that the defendant was obligated to pay the plaintiff 6 percent of the sale price as commission. The 6 percent of the sale amounts to $90,000 plus attorneys fees.

The defendant is accused of failing to comply with the terms of the agreement.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Gerald Wasserman of Gerald Wassermann LLC in Metairie.

The case has been assigned to Division F Judge Christopher J. Bruno.
