Former Arthur J. Gallagher & Co. employee alleged to be unlawfully soliciting customers

NEW ORLEANS – A Louisiana man formerly employed by an insurance business is accused of misappropriating trade secrets and confidential information.

Arthur J. Gallagher & Co. filed a complaint on April 3 in the U.S. District Court for the Eastern District of Louisiana against Brian D. O'Neill alleging breach of contract and other counts.

According to the complaint, the defendant was a former employee of the plaintiff and signed an executive agreement in 2007 prohibiting him from competing with the plaintiff for two years after termination of employment. The suit states O'Neill has been in contact with the plaintiff's customers to solicit them to transfer business from the plaintiff to Marsh USA.

The plaintiff alleges the value in lost commissions exceeds $75,000 and is expected to continue in the future unless the defendant is enjoined. 

The plaintiff seeks permanent injunction prohibiting defendant from divulging and using plaintiff's confidential, proprietary and trade secret information; compensatory damages; attorneys’ fees; costs and expenses; and such other just and proper relief.
