Bella Plus clothing store seeking damages for fire next to property

NEW ORLEANS – A clothing store claims that a fire in another building rendered their inventory useless.

Bella Plus LLC filed a lawsuit against Wilshire Insurance Co., Fiorella's on Decatur Inc., 1130 Decatur St. LLC and Western World Insurance Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff was a clothing store located at 1132-1133 Decatur St. The suit states that on March 31, 2016, the plaintiff's property was damaged by a fire at the adjacent building. The smoke damage to the plaintiff's inventory was allegedly so extensive that the plaintiff was not able to salvage the items.

The defendant is accused of negligence through failing to ensure that its property would not cause damages to the plaintiff's items and failing to prevent the fire from occurring.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys Brad P. Scott and Ashley Unsworth Schmidt of Scott, Vicknair, Hair & Checki LLC in New Orleans.

The case has been assigned to Division J Judge Paula A. Brown.
