NEW ORLEANS – Businesses are seeking damages after smoke from a fire damaged their items.
Dot's Angel B&B LLC, 1140 Decatur Street Condominium Association, Joey Lamartina and Angela Lamartina and John Boisdore and Sally Boisbore filed a lawsuit against Fiorella's On Decatur Inc., State Fire LLC, Safety Offshore Service Inc., Wilshire Insurance Co., Gold Leaf Investments LLC and certain underwriters at Lloyd's London Subscribing to policy number 574657 in Orleans Parish Civil District Court alleging negligence.
According to the complaint, Boisdore, was the owner of a condominium at 1140 Decatur St., New Orleans. The suit states that on March 30, 2016, there was a fire at 1136 Decatur St. The fire was unable to be contained because the fire extinguisher was expired. The smoke coming from the fire seeped into the plaintiff's property, causing damages to the plaintiff's possessions, which included fine art, among other items.
The defendant is accused of negligence through failing to ensure that the extinguisher was operating correctly, failing to take the necessary steps to prevent the fire in the first place and overall negligence.
The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Thomas M. Young of Hebbler & Giordano LLC in Metairie.
The case has been assigned to Division Judge.
