Children claim mother died after fall at Homelife in the Gardens

NEW ORLEANS – The adult children of a woman who died have filed suit against a New Orleans assisted living facility, alleging negligence of care.

Alberto Queral and Elsie Wilson filed a lawsuit April 11 against Homelife in the Gardens LLC in Orleans Parish Civil District Court.

According to the complaint, the plaintiff's mother, Julia Queral, became a resident of Homelife in the Gardens in February 2016. The suit states that she fell in April 2016 and was brought to the Touro Infirmary Hospital ER where she was treated for a dislocated right shoulder as well as a right ulna fracture. The suit states that on May 19, 2016, the woman was then transferred o a hospice facility and then died June 6, 2016.

The defendant is accused of negligence through failing to take the necessary steps to save her life, failing to see the danger and overall negligence in the level of care given.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Jessica L. Ibert of Lewis, Kullman, Sterbcow & Abramson in New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
